Terms of Service

Effective March 11, 2026

These Terms of Service ("Terms") govern your use of Osmo AI ("Osmo AI," "we," "us," or "our"), a voice-first AI assistant for iOS. By installing, accessing, or using Osmo AI, you agree to be bound by these Terms. If you do not agree, you may not use the service.

These Terms apply to your use of:

• The Osmo AI iOS application
• Our related backend services and APIs
• The website pages at https://osmo.website/privacy and https://osmo.website/terms

1. Description of Service

Osmo AI is an AI-powered assistant that helps you:

• Summarize email messages
• Answer questions about your inbox
• Show your calendar schedules
• Create or update calendar events when you ask it to

To provide these features, Osmo AI may:

• Connect to your Google account via OAuth after you explicitly grant permission
• Access your Google Calendar to read events and create or update events on your request
• Access your Gmail messages in read-only mode to summarize and answer questions about your inbox

Osmo AI is powered by a cloud backend (including a Python API and AI model providers) that processes your requests and generates responses.

2. Eligibility and Accounts

• You must be at least 13 years old to use Osmo AI.
• You must have the legal authority to agree to these Terms.
• You are responsible for:
  • Maintaining the security of your device and accounts
  • Ensuring that the information you provide is accurate and up-to-date
  • Any activity that occurs under your account or on your device

If you believe your account or Google connection has been compromised, you should revoke Osmo AI's access in your Google Account settings and contact us at sales@develloinc.com.

3. User Responsibilities

When using Osmo AI, you agree that you will:

• Use the service only for lawful purposes
• Not use Osmo AI to:
  • Violate any applicable law or regulation
  • Infringe the rights of others
  • Harass, abuse, or harm others
• Not attempt to:
  • Gain unauthorized access to our systems or other users' data
  • Reverse-engineer, decompile, or otherwise attempt to derive the source code or underlying models, except where allowed by law
  • Circumvent any usage limits or security measures

You are also responsible for complying with the terms and policies of any third-party services you connect to Osmo AI, including Google.

4. Third-Party Integrations

Osmo AI connects to and depends on several third-party services, including:

• Google APIs — for Gmail (read-only) and Google Calendar
• Cloud hosting and infrastructure providers
• AI model providers that process text and generate responses

Each of these services has its own terms of service and privacy policies. By using Osmo AI with these services, you agree to comply with their applicable terms as well.

Osmo AI does not control and is not responsible for:

• The availability, performance, or behavior of third-party services
• Changes to their APIs, policies, or pricing

If a third-party service becomes unavailable or changes in a way that affects Osmo AI, some features may be limited or disabled.

5. AI Limitations and No Professional Advice

Osmo AI uses artificial intelligence to generate responses based on your inputs and data.

• AI responses may be inaccurate, incomplete, or outdated.
• Osmo AI does not provide professional advice (including legal, medical, financial, or other professional services).
• You are solely responsible for how you use the information provided by Osmo AI and for verifying important information independently before acting on it.

You should not rely on Osmo AI as a sole source of truth for decisions that could affect your health, safety, finances, or legal rights.

6. Google Account Access and Permissions

When you connect your Google account:

• You grant Osmo AI permission to access Gmail read-only and Google Calendar using OAuth.
• Osmo AI accesses your Google data only for the purposes described in these Terms and the Privacy Policy.

Osmo AI:

• Does not send emails, modify emails, or delete emails through Gmail APIs.
• Reads Gmail messages only to summarize your inbox and answer questions you ask.
• Reads and writes Google Calendar data only to display schedules and create or update events when you request it.

You can revoke Osmo AI's access to your Google account at any time in your Google Account settings: https://myaccount.google.com/permissions.

7. Fees and Changes to the Service

Osmo AI may be offered as a free or paid service. We may introduce or change pricing, subscription plans, or feature tiers in the future. If we introduce material changes to pricing that affect you, we will aim to provide reasonable notice through the app or by other appropriate means.

We may also add, change, or remove features and limit the service's availability in certain regions or on certain devices.

8. Intellectual Property

Osmo AI and all related content, features, and technology are owned by us or our licensors. This includes:

• The app's design, branding, logos, and user interface
• The software code and models that power the service
• Any documentation or website content we provide

You retain ownership of your own content and data, including emails and calendar events accessed through your connected accounts. By using Osmo AI, you grant us a limited license to process your content only as necessary to operate the service, provide the features you request, and maintain and improve the service in ways consistent with the Privacy Policy and applicable law.

9. Account Suspension and Termination

We may suspend or terminate your access to Osmo AI, with or without notice, if:

• You violate these Terms or applicable law
• We reasonably believe your use of the service may cause harm to other users, us, or third parties
• We are required to do so by law or by a third-party service provider (for example, Google)

You may stop using Osmo AI at any time. You can also revoke Osmo AI's access to your Google account and request deletion of your data (see Data Deletion and the Privacy Policy). Suspension or termination will not automatically delete your data; you should submit a deletion request if you want us to remove it from our systems, subject to legal requirements.

10. Disclaimers

Osmo AI is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we:

• Do not make any promises about the service's availability, reliability, or accuracy, or the correctness or completeness of AI-generated responses.
• Disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law:

• We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or business opportunities, arising from or related to your use of Osmo AI, your reliance on AI-generated responses, or the actions or omissions of third-party services (such as Google APIs).
• Our total liability for any claims relating to the service will be limited to the amount you have paid to us for Osmo AI (if any) in the 3 months before the event giving rise to the claim, or the minimum amount required by applicable law where such limitation is not enforceable.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In those cases, we will limit our liability only to the extent permitted by law.

12. Indemnification

To the extent permitted by law, you agree to be responsible for (and indemnify and hold harmless) Osmo AI and its owners, employees, and partners from and against any claims, losses, or damages arising from:

• Your violation of these Terms
• Your misuse of Osmo AI
• Your violation of any third-party rights or applicable laws while using the service

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top. For material changes, we may provide additional notice (for example, in-app or by email, when appropriate). If you continue to use Osmo AI after the updated Terms become effective, that use will constitute your acceptance of the updated Terms.

14. Governing Law

Unless required otherwise by local law, these Terms are governed by and construed in accordance with the laws of the jurisdiction where Osmo AI is primarily operated, without regard to conflict-of-law rules. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
